Legal Concerns for Digital Evidence Responders 601: Post-Seizure Evidentiary Concerns
Legal Concerns for Digital Evidence Responders provides a
legal background for first responders and investigators who encounter or work
with digital evidence. Topics include Fourth Amendment concerns, the importance
of getting digital devices into the hands of a forensics expert, recent case
law, and practical advice on obtaining and executing search warrants. The
modules function as companions to NW3C’s computer crimes classes and may be
required as online prerequisites for either instructor-led or online training.
Each module can be completed as a stand-alone online course or in combination
with the other six modules.
While previous modules deal with acquiring digital
evidence, whether with a search warrant, through
the SCA, or via an online undercover operation, this module addresses the legal issues that
appear later in the investigative and judicial process. Topics covered include:
- The Fifth Amendment as it applies to passwords and other login credentials
- Determining the ownership of files on a device
- Admissibility of online evidence
